C.M.P.No.6947 of 2024 in C.M.A.SR.No.6180 of 2024 N.ANAND VENKATESH, J.

This Civil Miscellaneous Petition has been filed seeking to condone the delay of 279 days in filing the CMA against the order passed in M.C.O.P.No.40 of 2017 on the file of the Motor Accident Claims Tribunal, Sub Judge, Nagapattinam, dated 23.12.2022.

2.Heard the learned counsel for the petitioner and perused the records.

3.Affidavit of service has been filed. It is seen that the private notice has been served on the respondent. There is no appearance for the respondent either in person or through counsel.

4.Having satisfied with the reasons assigned in the affidavit filed in support of this petition, the miscellaneous petition is allowed and the delay of 279 days is condoned.

5.Registry is directed to number the main Civil Miscellaneous Appeal and list the same for admission.
