Respondents Prayer: Writ Petition is filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, to direct the first respondent police or their sub-ordinates not to harass the petitioner and his family members in the guise of an enquiry based on a complaint of the second respondent except according to the process established by law.

ORDER

This Writ Petition has been filed seeking for a direction to direct the first Respondent not to harass the Petitioner and his family members.

2. Heard learned counsel appearing for the petitioner and the learned Government Advocate (Crl. Side) appearing for the first respondent.

3. Taking into consideration the fact that the nature of the dispute involved in this case is a matrimonial dispute, it is for the parties to redress the same before the appropriate Civil Court and the respondent police will have no role to play in a case of this nature.

4. This Writ Petition is disposed of with a direction to the respondent police not to interfere with the matrimonial dispute and it is open for the parties to agitate their rights before the competent civil court. No costs.
