Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India seeking a writ of mandamus to direct the respondents 1 to 3 to issue a prior notice to the petitioner before changing any patta in favour of the fourth respondent for the property bearing Survey No.17/6B/3B, to an extent of 0.88.0 ares, i.e. 2.17 cents as requested in the petitioner's representation dated 11.04.2013 and subsequent legal notice dated 02.09.2013.

ORDER

The petitioner has filed this writ petition seeking for issuance of a writ of mandamus to direct the respondents 1 to 3 to issue a prior notice to her before changing any patta in favour of the fourth respondent in respect of the property bearing Survey No.17/6B/3B having an extent of acres 2.17 cents.

2. When the matter is taken up, learned Special Government Pleader appearing for the respondents 1 to 3 submitted that the petitioner has wrongly filed this writ https://hcservices.ecourts.gov.in/hcservices/

petition seeking not to issue patta in favour fourth respondent as though the official respondents are taking steps to change the patta. Even now, the patta stands in the name of the petitioner and therefore, if any such decision is taken, then definitely the petitioner would be put on notice and only thereafter, final decision would be taken for change of name in the patta. He has also produced a copy of Patta No.522, whereby it is seen that even now the patta stands in the name of the petitioner in respect of the property in question. The said submission is recorded.

3. In view of the aforesaid submission, nothing survives in the writ petition and accordingly, it is dismissed. No Costs. Consequently, connected miscellaneous petitions are closed.
