Defendants (Defendant Nos.2 to 4 are brought on record as legal heirs of the deceased first defendant as per order dated 20.10.2021 in A.No.3311/2021 and time extended as per order dated 31.03.2023) Prayer: Plaint filed under Order IV Rule 1 of Original Side Rules read with Order VII Rule 1 of C.P.C. prays for a judgment and decree against the defendants (a)directing the defendants to pay to the plaintiff the sum of Rs.1,05,77,401/- (Rupees One Crore Five Lakhs Seventy Seven Thousand Four Hundred and One only) together with the interest at the rate of 24% per annum from the date of Memorandum of Agreement for Joint Venture Agreement till the date of realisation; and (b)directing the defendants to pay to the plaintiff the costs of this suit.

JUDGMENT
Learned counsel for the plaintiff as well as the learned counsel for the defendants would submit that the parties have settled the matter out of Court. They have made an endorsement to that effect in the Court bundle. Accordingly, this suit is dismissed as settled out of Court. 2.The counter claim filed by the defendants is also settled out of Court. The respective parties are entitled for refund of Court fees. 3.Registry is directed to refund the entire court fees, paid by the respective parties. No costs.
