By consent, the main writ petition is taken up for final disposal.

2. The petitioner claims that after completing his Higher Secondary Course under the Board of Secondary Education, he applied to Arignar Anna Institute of Science and Technology, Pennular, Sriperumbudur Taluk, the 2nd respondent herein, to undergo B.E. (Computer Science and Engineering) under Management quota and he was admitted to the 1st year B.E. (Computer Science and Engineering) in 2004 and after completion of two years Course, there was no sufficient infrastructure and amenities in the 2nd respondent institution, which also lead to agitations and demonstrations by

the students studying in the said institution and the Commissioner of Technical Education, Chennai, has also taken note of the fact and transferred the willing 5th Semester students of the said institution to Raja Rajeswari College of Engineering, Chennai, vide proceedings dated 19.09.2006 and the petitioner was one among the students who have been admitted to the said institution during 2006 in the 3rd year B.E. (Computer Science and Engineering) and completed the course during April 2008 in first class and a degree was also awarded by Anna University, during April 2008.

The grievance expressed by the petitioner is that though he received the Degree certificate from the University, the original SSLC Mark Sheet, Higher Secondary Mark Sheet and the 1st to 4th Semester Mark Sheets of B.E. (Computer Science and Engineering), have not been returned by the 2nd respondent institution and in this regard, he submitted a representation dated 17.03.2015 to both the respondents and though, the 1st respondent in turn has directed the 2nd respondent to respond to the same, he has not been favoured with any kind of response, hence, came forward to file this writ petition.

4. Heard the submissions of Ms.R.R.Soundhari, learned counsel appearing for the petitioner and Mr.M.Vijayakumar, learned standing counsel, who accepts notice for the 1st respondent.

The attention of this Court was also drawn to the orders dated 23.09.2010 made in W.P.Nos.12213 to 12215 of 2010 as well as dated 16.02.2015 made in W.P.Nos.3828 to 3830 of 2015, wherein this Court directed the concerned institution to return the certificates to the petitioners therein subject to the conditions that the petitioners therein shall pay all the amounts, which are legally due and payable by them.

6. In the considered opinion of this Court, the petitioner is similarly placed and therefore the above said orders would be applicable to him also. Therefore, in the result, the writ petition is disposed of and the 2nd respondent is directed to return the original testimonials / certificates as well as the Mark Sheets to the petitioner in terms of his representation dated 17.03.2015, subject to the condition that he shall pay all the amounts, which are legally due and payable by him.
