THE HONOURABLE MR.JUSTICE T.RAJA W.P.No.5765 of 2018 K.Sathaiah ..

Petitioner -vs1. The Secretary Ministry of Chemicals & Fertilisers Department of Fertilisers Shastri Bhavan New Delhi

2. Chairman & Managing Director (CMD) Madras Fertlizers Limited Manali Chennai 600 068 ..

Respondents Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, directing the respondents to dispose of the representation dated 19.02.2018. For Petitioner :: Mr.S.Hemanand

ORDER

This writ petition has been filed seeking a mandamus to the respondents to consider the representation of the petitioner without even producing any rule whatsoever to support the prayer that the petitioner should be promoted to the post of E-1 Senior Officer with effect from 1.6.2003. The affidavit sworn in having only one page, is totally bereft of any detail with regard to the entitlement and also the rule position supporting the prayer of the petitioner for promotion to the higher post. This Court, merely on the basis of the one page affidavit not having anything to substantiate the prayer, is not able to accept the case of the petitioner. Therefore, the prayer made by the petitioner is refused and the writ petition stands dismissed.
