A.Nos.1278 & 1773 of 2022 in C.S.(Comm.Div) No.37 of 2021 SENTHILKUMAR RAMAMOORTHY, J The suit is at the pre-trial stage. Both the plaintiff and the defendants have filed applications for permission to produce the additional documents described in the schedule to the respective judge's summons.

2. The plaintiff states that the production of these documents is necessitated by the defence taken in the written statement of the defendants. Likewise, the defendants state that the production of these documents is necessitated to establish the adjustments made by the defendants in relation to the transactions which form the subject matter of the suit claim.

3. Upon considering the submissions and on examining the affidavit in support thereof, the plaintiff and the defendants, respectively, have established reasonable cause in the facts and circumstances. Accordingly, A.Nos.1278 and 1773 of 2022 are allowed.

4. The respective counter party is permitted to file an affidavit of admission/denial in respect of these documents. In addition, the respective counter party is permitted to raise objections inter alia on grounds of relevance, proof and admissibility.
