Writ Petition filed under Article 226 of the Constitution praying to issue a Writ of Mandamus, directing the 1st Respondent to defreeze the Petitioner's bank account maintained in the 1st respondent bank bearing Account number 1854135000001910 within the time frame fixed by this Court.

O R D E R

This Writ Petition has been filed to direct the first respondent to defreeze the petitioner's bank account maintained in the 1st respondent bank bearing Account Number 1854135000001910, within the time frame that may be fixed by this Court.

2. The learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the fourth respondent. Though notice has been served, the first to third respondents have not entered appearance, either in person or through Counsel. 2/6

On a perusal of records, it is revealed that on the complaint lodged by the de-facto complainant before the second and third respondents, they requested the first respondent to freeze the account of the petitioner, since a sum of Rs. 50,000 has been deposited in the petitioner's account from the accused. Further, a sum of Rs. 30,000 has been deposited by the accused into the petitioner's account. Subsequently, if the said amount is marked as lien and disputed amount, the petitioner may be permitted to operate his account.

4. In view of the above, a sum of Rs. 80,000 is hereby marked lien on the complaint lodged by the de-facto complainant on the file of the second and third respondents, and the petitioner is permitted to operate his account in respect of the remaining amount in his account lying with the first respondent. It is made clear that the first respondent is directed to withhold the amount of Rs. 80,000 from the account of the petitioner and permit him to operate his account insofar as the remaining amount. 3/6

5. With the above directions, this Writ Petition is disposed of. Consequently, the connected Miscellaneous Petition is closed. No costs. 27.03.2025 Index:Yes/No kv To
