ORDER

The petitioner apprehends arrest for the alleged offence under Section 420 of IPC, 1860, in Crime No.147 of 2024 on the file of the respondent police seeks anticipatory bail.

2. Earlier, this Court had thrice dismissed the bail petition of the petitioner.

3. The allegation against the petitioner is that the petitioner is ranked as A1 in this case he joined hands with the two other accused involved in job rocketing, by promising to secure jobs in Government Departments and collected a sum of Rs.26.70 lakhs from six victims and subsequently, he cheated them. Hence case has been registered.

4. The learned counsel for the petitioner submitted that though the petitioner has been alleged that the petitioner has collected a sum of Rs.13.40 lakhs, he repaid the same and to prove the same, the documents have also been produced before the Investigation Officer. He further submitted that the though the money was deposited to the petitioner's bank account, it was transferred to the account of A2 and he was not personally benefited from the transaction. He further submitted that this petitioner is the victim in the hands of A2 and he has lost a sum of Rs. 3.5 lakhs. He further submitted that he is ready to abide by any stringent condition that may be imposed by this Court and he is ready to cooperate for investigation. Hence, he prays to grant anticipatory bail to the petitioner.

5. The learned Government Advocate (Crl.Side) appearing for the

respondent police reiterated the prosecution's case and upon instructions, submitted that no money is recovered in this case so far and the petitioner has also played a very vital role in collecting the money from the defacto complainants and others. Hence, she opposed to grant anticipatory bail to the petitioner.

I have also gone through the earlier orders and this is the fourth bail petition and though it is stated that the petitioner has handed over the money to A2, there is no material to substantiate the same, and even if the same is accepted, the petitioner is the one who has induced the other accused to part with the money and he colluded with other accused and cheated the victims. Hence, this court is not inclined to grant anticipatory bail to the petitioner.
