Writ Petition filed under Article 226 of the Constitution of India, praying to issue a writ of Mandamus, directing the Respondents 1 and 2 to issue order of appointment to the post of Computer Instructor Cadre-I (PG cadre) in favour of the Petitioner pursuant to the selection list issued by the 2nd Respondent dated 11.01.2020 and the second selection list dated 28.12.2020 under BC Reserved category forthwith, with all consequential and other attendant benefits.

Petitioner has come up with this Writ Petition seeking a direction to Respondents 1 and 2 to issue order of appointment to the post of Computer Instructor Cadre-I (PG cadre) in her favour, pursuant to the selection list issued by the 2nd Respondent dated 11.01.2020 and the second selection list dated

28.12.2020 under BC Reserved category forthwith, with all consequential and other attendant benefits.

According to the Petitioner, she secured a Certificate from the University that, B.Sc. (Computer Science and Computer Application) acquired by her is equivalent to B.Sc. (Computer Science) and hence, she is eligible for appointment to the post of Computer Instructor for taking classes in Computer Science and Computer Application subjects. It is her case that, her selection to the post of Computer Instructor cannot be withheld in the name of claiming equivalence. Hence, having no other alternative, the Petitioner has come up with this Writ Petition with the above relief.

Heard the learned counsel on either side and perused the material documents available on record.

Considering the facts and circumstances of the case, this Court directs the 1st and 2nd Respondents herein to consider the case of the Petitioner as regards issuance of appointment order to the post of Computer Instructor Cadre - I (PG cadre) in her favour, on merits and in accordance with law, after affording an opportunity of personal hearing to the Petitioner, and pass appropriate orders on the same, within a period of sixty days from the date of receipt of a copy of this order. With the above direction and observation, this Writ petition stands disposed of. No costs. Consequently, connected W.M.P.No.6943 of 2021 is closed.
