ORDER

Heard Mr.D.Nellaiappan, learned counsel for the petitioner and Mr.M.Arunkumar, learned counsel for the respondent.

2. The learned counsel for the parties bring to my notice that in connected/similar matters, the respective petitioners therein were permitted to purchase the land under their occupation at the rate of Rs.10,000/- per sq.ft. since the superstructure had been put up by them. In the present case as well, it is the case of the petitioner that the land was originally leased out to him and that the superstructure belongs to the petitioner.

3. The learned counsel for the petitioner states that the petitioner is agreeable to offer Rs.8,000/- per sq.ft. for the land in question. However, the learned counsel for the respondent states that the respondent is willing, provided the petitioner increases the offer to Rs.10,000/- per sq.ft.

4. The learned counsel for the petitioner on instructions from the petitioner, states that the petitioner is willing to pay Rs.10,000/- per sq.ft. and purchase the land.

5. In the light of the above, the Civil Revision Petition is allowed, directing the petitioner to purchase the land in question from the respondent for

a consideration at the rate of Rs.10,000/- per sq.ft. Time for completion of payment and execution of sale deed is four months. No costs. Consequently, connected miscellaneous petition is closed.
