The petitioner, who was arrested and remanded to judicial custody on 12.08.2022 for the offences punishable under Section 8(C), 20(b) (ii) (B) of Narcotic Drugs and Psychotropic Substances Act, 1985 in Crime No.637 of 2022, on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the defacto complainant along with other police officials conducted routine raid, wherein they found the petitioner was in illegal possession of 2 kgs of ganja and the same was seized by the respondent police. Hence, the complaint.
3. Learned counsel for the petitioner submitted that subsequent to the arrest he was detained Act - 14 as Drug Offender and said detention order was set aside by the Advisory Board and after set aside the detentions order, the respondent police filed charge sheet. He further submits that he is ready and willing to abide any condition that may be imposed by this Court and he has been suffering incarceration from 12.08.2022. Hence, he prays to grant bail to the petitioner.
4. Learned Government Advocate (Crl.Side) submitted that the
petitioner was found in illegal possession of 2 kgs of ganja and the same was seized by the respondent police. He further submits that the petitioner has 36 previous cases pending against him including 7 NDPS cases and 29 IPC cases and he is a history sheeter. Hence, he vehemently opposed to grant bail to the petitioner.
5. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) and perused the materials available on record.
6.Taking into consideration the facts and circumstances of the case, the submissions made by the learned Government Advocate (Crl.Side) and taking note of the gravity and nature of the offence, this Court is not inclined to grant bail to the petitioner.
7. Accordingly, this Criminal Original Petition stands dismissed.
