ORDER

Transfer Petition filed seeking to withdraw H.M.O.P. No.528 of 2025 pending on the file of the Subordinate Court, Poonamallee, and to transfer the same to the file of the VI Additional Family Court, Chennai, to be tried along with M.C. No.608 of 2025 pending on the file of the VI Additional Family Court, Chennai.

2. The learned counsel for the petitioner submitted that the respondent/wife has already filed M.C.No.608 of 2025 before the VI Additional Family Court, Chennai, seeking maintenance and that the same is pending. The petitioner seeks transfer of H.M.O.P. No.528 of 2025, which is pending on the Subordinate Court, Poonamallee to the VI Additional Family Court, Chennai. It is further submitted that she is residing with the children and has no independent source of income, whereas the respondent/husband is a businessman having sufficient means.

3. Though notice was served, the same was returned with an endorsement "vacated". The reasons stated by the petitioner are found to be justifiable.

4. Accordingly, H.M.O.P. No.528 of 2025 pending on the file of the Subordinate Court, Poonamallee, is withdrawn and transferred to the file of the

VI Additional Family Court, Chennai. On receipt of the records and after taking the case on file, the Trial Court is directed to issue notice to both parties and proceed with the matter in accordance with law.
