O R D E R
The Revision Petitioner is the landlord, he has filed a petition in RLTOP No. 42 of 2021 before the Principal District Munsif, Alandur/Rent Court seeking for eviction of the respondent/tenant by invoking Sec.21(2)(B), 21(2)(D) and 23 of Tamil Nadu Regulation of Rights and Responsibilities of Landlords and Tenants Act, 2017 as amended by Act, 2018.
2. Notice served on the respondent/tenant and he appeared through his counsel before the Rent Controller, but the Rent Controller adjourned the matter without concluding enquiry. The revision petitioner herein, who is aged about 80 years old man and he is a senior citizen filed this petition to issue a direction to the learned Principal District Munsif, Alandur to dispose the RLTOP No. 41 of 2021 as early as possible.
2. As the relief claimed by the Revision Petitioner only seeking for a direction to speedy disposal, the notice to the respondent is dispensed with.
3. On seeing the facts and on perusal of records, it would reveals that the Revision Petitioner is aged about 80 years, has filed the said petition in 2/4
RLTOP No.41 of 2021 for eviction against tenant and the tenant also appeared through his counsel, but it was not taken on file as per the case status. The main object of the new amended Act is to dispose the rent control O.P. proceedings within a month, but without considering the same, it has adjourned the matter for two years, as such, it is impermissible one. Hence, the prayer sought by the Revision Petitioner is justifiable one. Therefore, this Court is inclined to direct the learned Principal District Munsif/Rent Court, Alandur to dispose the RLTOP No. 41 of 2021 within a period of eight weeks without giving unnecessary adjournments from the date of receipt of copy of this order. Accordingly, this Civil Revision Petition is disposed of on merits. No costs.
