The learned counsel appearing for the petitioner submitted that the suit in O.S.No.813 of 2010 on the file of the Principal District Munsif Court, Erode itself was dismissed for default on 14.12.2016, therefore, the relief sought for in the Civil Revision Petition has become infructuous. va further submitted that in the event of the suit being restored to file, the petitioner may be given liberty to restore the Civil Revision Petition to file. 2.In view of the submission made by the learned counsel for the petitioner, the Civil Revision Petition stands dismissed as infructuous. The petitioner is given liberty to file appropriate petition to restore the Civil Revision Petition in the event of the suit in O.S.No.813 of 2010 being restored to file. No costs. Consequently, the connected miscellaneous petition is closed.
