1.This is an application seeking modification of an order, dated 12.08.2016, passed in Comp.A.No.718 of 2016, to the extent that it directs that company petition be presented on or before 12.09.2016. 1.1 The said application (i.e., Comp.A.No.718 of 2016) was moved by the applicant company i.e., Transferor Company No.2, on that date, for a direction to dispense with the convening, holding and conducting the meeting of its equity share holders. 1.2 On that date, this Court had also dealt with several other applications including Comp.A.Nos.719 of 2016 and 720 of 2016. These applications also pertain to the applicant company i.e., Transferor company No.2.

2.Furthermore, on 12.08.2016, orders were also passed in Comp.A.No.718 of 2016, as indicated above, whereby, holding of the meeting of the equity share holders was dispensed with. 2.1 Orders were also passed in Comp.A.Nos.719 and 720 of

2016, whereby it was directed that the meeting of the secured and unsecured creditors would be convened on 15.09.2016. 3.It appears that, inadvertently, while passing an order in Comp.A.No.718 of 2016, this Court had directed that the company petition should be presented on or before 12.09.2016. 3.1 It is for this reason that modification, is sought, of order dated 12.08.2016 passed in Comp.A.No.718 of 2016. 4.Accordingly, as prayed, order, dated 12.08.2016, passed in Comp.A.No.718 of 2016 is modified to the extent that leave is given to the applicant to present the company petition on or before 07.10.2016.

4.1 All other directions in Comp.A.No.718 of 2016 will remain unaltered.

5.Comp.A.No.796 of 2016 is, accordingly, disposed of. 01.09.2016 kj RAJIV SHAKDHER,J.
