Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to (i) Extend the time to surrender and to execute sureties by a further period of 2 weeks in Crl.O.P.NO.1232 of 20222 dated 20.01.2022.[Crl.MP.No.4038/2022] (ii) Modify the condition in respect of condition No.5(b) imposed in Crl.O.P.No.1232 of 2022 dated 20.01.2022 and pass such further or other orders.[Crl.MP.No.4041/2022] Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S. M.CHANDRASEKAR, Advocate for the petitioner and of MR.L.BASKARAN, Govt. Advocate (Crl. Side) on behalf of the Respondents the court made the following order:- Crl.MP.No.4038 of 2022:
This petition has been filed by the petitioner to extend the time granted by this Court in Crl.O.P.No.1232 of 2022 dated 20.01.2022 for executing the sureties before the concerned Magistrate.
Crl.MP.No.4041 of 2022:
This petition has been filed by the petitioner to modify one of the conditions imposed on him by this Court in Crl.O.P.No.1232 of 2022 dated 20.01.2022.
2. This Court is not inclined to modify the condition which was already granted, because, on hearing the petitioner only, the said order was passed. More over, the petitioner is inclined to deposit the said amount. Now, after coming out of the bail by not complying the order, then he seeks to modify the condition which is unsustainable in law and this petition is not maintainable. Hence,this Court is not inclined to modify the condition. However, time granted by this Court in Crl.OP.No.1232 of 2022 dated 20.01.2022 is extended by a period of two weeks from the date of receipt of a copy of this order for the purpose of complying with the order.
3. These Criminal Miscellaneous Petitions in respect of Crl.MP.No.4038 of 2022 stands ordered and in respect of Crl.MP.No.4041 of 2022 stands dismissed.
