ORDER

Writ petition has been filed in the nature of mandamus seeking a direction to appoint the petitioner as Junior Assistant in the office of the first respondent.

In the affidavit filed in support of the petition, it had been stated that the petitioner has completed B.B.A degree from the Pondicherry University and M.C.A from the Annamalai University. He also had completed P.G Diploma in Co-operative Management and had also passed lower grade in English typewriting. He also registered himself with the Employment Exchange.

Naturally, there was a reasonable expectation that the petitioner would be given an opportunity to apply for any posts in consonance with the qualifications obtained by him. It had been stated in the affidavit that several other persons had been appointed in the Puducherry Co-operative Department and Societies though without any qualification.

It will only be appropriate for the petitioner to give his representation in writing stating his educational qualifications and also the seniority in the employment exchange, which may be forwarded to the first respondent herein. If any vacancy arises, the first respondent may also invite the petitioner to apply but naturally the selection would be only on the basis of a lawful process which the first respondent should adopt. If the petitioner is successful, he would be offered employment in the place of first respondent or any other Co-operative Department in the Union Territory of Puducherry.
