This petition has been filed to set aside the Award dated 09.10.2009 in ACP (CC) No. 40 of 2008.

2. The parties were referred to mediation and have reached on an agreement before the Mediator.It is stated by the counsels that all the requirements of the Mediation Agreement have been complied with.

3. Hence, the original petition is dismissed as settled out of court. No costs.
