These applications have been filed seeking an order against the third respondent / third defendant from alienating the suit property and also not to interfere with the peaceful possession of the plaintiffs.

The plaintiffs are the tenants in the suit property which is situated in Plot No.R-12/3, Kodungaiyur, Phase - II, Tamil Nadu Housing Board, Door No.3, Muthamil Nagar, III Block, 51st Street, Kodungaiyur, Chennai 600 118, measuring about 2119 Sq.ft. The plaintiffs and the third defendant had orally entered into an agreement of sale of the property for a sum of Rs.2,60,00,000/- and the plaintiffs are continuing in possession and have filed these applications.

3. The learned counsel for the third respondent / third defendant is well aware of the fact that only under due process, could eviction be sought. If at all the third defendant wants to sell the property, he is always at liberty since as on date he is the owner of the property, but it will only be appropriate if it is informed to this Court and leave of this Court is obtained before selling the suit property.
