O R D E R

The trial of the case in O.S. No.187 of 2013 has commenced and cross examination of DW1 is also completed. At this stage, the said defendant took out an application for appointment of a commission for local inspection. When the Commissioner was appointed, he had filed an interim report and thereafter, he vanished. Now the case is pending for close to five years, without any progress.

2. If the statement made across the bar were to be trusted, then it only indicate that the trial court is contributing its mite for the delay in disposing the suit. The appointment of commission is only in aid of the suit, and it cannot halt the proceedings of the trial infinitely.

3. The learned District Munsif, Ponneri, is now required to dispose of O.S. No.187 of 2013, within a period of three months from the date of communication of this order, at any rate, not later than August, 2022.

4. With the above direction, this Civil Revision Petition stands disposed of. No costs.
