Petition praying that in the circumstances stated therein the High Court will be pleased To Modify the condition in Crl.O.P.No.12608 of 2017 dated 12.7.2017.
Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.C.ARIVAZHAGAN, Advocate for the petitioner and of MR. P. MUTHU KUMAR, Govt. Advocate ( Crl. Side) on behalf of the Respondent the court made the following order:- This petition is filed to modify the condition imposed on the petitioner in Crl.O.P.No.12608 of 2017, dated 12.07.2017.
2. This court, while granting bail to the petitioner, imposed conditions that the petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a likesum to the satisfaction of the learned Judicial Magistrate No.II, Poonamallee and the petitioner shall stay at Villupuram and appear before the learned Judicial Magistrate No.II, Villupuram daily at 10.00 a.m., and 5.00 p.m., for a period of two weeks and thereafter, shall report before the respondent police daily at 10.00 a.m and 5.00 p.m for a period of two weeks and thereafter, as and when required for interrogation. 3.Heard both sides.
4.The learned counsel for the petitioner submitted that one of the condition that the petitioner shall stay at Villupuram and appear before the learned Judicial Magistrate No.II, Villupuram daily at 10.00 a.m., and 05.00 p.m., for a period of two weeks,
has been complied with. Further, he submitted that the other condition is that the petitioner shall report before the respondent police daily at 10.00 a.m., and 05.00 p.m., for a period of two weeks and thereafter, as and when required for interrogation. Since the respondent-police is harassing the petitioner, this petition has been filed for the aforesaid prayer.
5.Considering the submission made by the learned counsel for the petitioner, the condition imposed on the petitioner in Crl.O.P.No.12608 of 2017 dated 12.07.2017 that the petitioner shall report before the respondent police daily at 10.00 a.m, and 05.00 p.m, for a period of two weeks and thereafter as and when required for interrogation, is modified to the effect that the petitioner shall report before the learned Judicial MagistrateII, Poonamallee daily at 10.00 a.m, and 05.00 p.m, for a period of two weeks and thereafter as and when summoned. Except the above modification, the other conditions remains unaltered.
6. Accordingly, this petition is ordered.
