Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents 1 to 4 to take appropriate action against the respondents 5 to 15 from constructing any superstructure for temple on the public road at Vozhaiyur Village, Uthiramerur Taluk.

O R D E R

The relief sought for in this writ petition is to direct the respondents 1 to 4 to take appropriate action against the respondents 5 to 15 from constructing any superstructure for temple on the public road at Vozhaiyur Village, Uthiramerur Taluk, is under challenged in this writ petition.

2. The learned counsel appearing on behalf of the writ petitioner as well as the respondents made a submission that during the pendency of the writ petition, the construction already put up was demolished by the Competent Authority. It is made clear that the land in question is a public road and there should not be any further construction or otherwise in respect of the particular land. The said land is to be made available for the usage of all public as a public road. The Collector should ensure that there is no encroachment or otherwise in respect of the public roads and lands.

3. With this observation, the writ petition stands disposed of. However, there shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
