ORDER

This writ petition has been filed for issue of writ of mandamus directing the 1 st respondent to deal with the on-line application submitted by the petitioner on 25.12.2024, wherein, the petitioner is seeking for survey of the subject property and for demarcation of boundaries.

2.Heard Mr.J.Rajmohan, learned counsel appearing on behalf of the petitioner and Mr.A.Selvendran, learned Special Government Pleader appearing on behalf of the 1 st respondent.

3/4 3.In the considered view of this Court, an Appeal Suit is pending in A.S.No.114 of 2024 before the City Civil Court at Chennai. Hence, when the civil case is pending, the revenue authorities will not survey the property without a specific direction issued by the Court. Hence, the petitioner has to file an appropriate petition in the pending appeal and seek for the survey of the property by way of appointment of an Advocate Commissioner. That will be the proper procedure to be followed in a case where civil proceedings are pending and one of the party wants a survey to be conducted in the property. Except given this clarity and liberty, no further orders can be passed in this writ petition.
