J U D G M E N T

The learned counsel for the appellants made a submission that the original suit was instituted for partition and the preliminary decree was passed, against which the present appeal suit is filed. During the pendency of the present appeal suit, the parties have settled the issues out of Court.

2. In this regard, the learned counsel for the appellants submitted a copy of the Survey Plan, wherein the parties have accepted the same and settled the issues out of Court.

3. The learned counsel for the appellants made an endorsement to the said effect in the case bundle also. Thus, the appellants are permitted to withdraw the present appeal suit.

of. However, there shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
