PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Mandamus directing the first respondent to dispose of the petitioner's representation dated 16.3.2015 and complete the departmental enquiry pending against the petitioner within a specified date.
For Petitioner : Mr.V.Bhiman For Respondents: Mr.S.Haja Mohideen Gisthi Order of the Court was made by V.RAMASUBRAMANIAN,J The petitioner, who is working as Junior Bailiff in the Court of Small Causes, has come up with the above writ petition seeking a Mandamus to direct the first respondent to dispose of his representation for completion of departmental enquiry pending against him.
2. Heard Mr.V.Bhiman, learned counsel for the petitioner. In view of the limited nature of the prayer, we directed Mr.S.Haja Mohideen Gisthi, learned Standing counsel to take notice for the respondents.
3. The disciplinary enquiry against the petitioner was initiated by the issue of a charge memo dated 15.9.2012 under Rule 17(b) of the Tamil Nadu Civil Services (Discipline and Appeal) Rules. The petitioner gave his explanation on 10.7.2013. The enquiry commenced on 13.8.2013. Now, it stands posted to 14.5.2015. The petitioner is due to retire, on reaching the age of superannuation, by 31.5.2015. https://hcservices.ecourts.gov.in/hcservices/

In view of the above, without expressing any opinion on the merits of the case, the writ petition is disposed of, directing the first respondent to consider the representation of the petitioner dated 16.3.2015, complete the disciplinary proceedings and pass appropriate orders preferably on or before 31.5.2015, so that the proceedings initiated are not rendered nugatory. No costs.
