This petition has been filed to direct the respondent to depute an investigation officer to register the complaint dated 6.5.2015 and further direct the investigation officer to investigate and file a final report.

Heard the learned counsel appearing for the petitioner as well as the learned Additional Public Prosecutor appearing for the State.

On going through the complaint it appears that the petitioner has made a complaint to the CBCID for investigation. CBCID can investigate the case only on the orders of the superior Police Officers or on the orders of this Court. 4.

Under such circumstances, the petitioner is directed to submit a fresh complaint to the jurisdictional police and on such complaint being made, the concerned police is directed to enquire the same, and during the course of the enquiry, if any cognizable offence is made out, a regular case shall be registered, following the law laid down by the Hon'ble Supreme Court in Lalita Kumari Vs. Government of Uttar Pradesh and Others reported in (2014) 2 SCC 1. https://hcservices.ecourts.gov.in/hcservices/

The Criminal Original Petition is closed with the above directions.
