CRIME NO.1089 OF 2021 Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to modify the condition imposed on him in the above Crl.o.P.No.2579/2022 to appear before the respondent police on Every Wednesday at 10.30 a.m., until further to as and when required. Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.G.ASHOK KUMAR, Advocate for the Petitioner and of MR.L.BASKARAN, Govt. Advocate (Crl. Side) on behalf of the Respondent the court made the following order:- The Petitioner has filed this petition seeking to modify the condition in Para 5(d) ''that the petitioner to appear before the respondent police on every Wednesday at 10.30 a.m., until further orders'', imposed by this Court in Crl.O.P.No.2579 of 2022 dated 04.02.2022.
2. The learned Counsel appearing for the petitioner submitted that the petitioner has complied with all the conditions imposed on him, except the condition No.5(d) to appear before the respondent, because the respondent was arrested even before his release from this case by the Kerala Police in connection with Crime No.26 of 2021. Moreover, other conditions of order were complied with before the
learned Special Court for EC Act Cases on his production by the Kerala Police. Now, the petitioner is still inside the Kakkanadu Jilla Prison, Kerala. Hence, the petitioner could not comply with the conditions imposed by this Court. Hence, the present modification petition has been filed.
3.The learned Government Advocate (Crl.Side) appearing for the respondent submitted that the petitioner has not filed any application before the Kerala High Court.
4. Considering the above submissions so made by the learned Government Advocate (Crl.Side), this petition is not maintainable and this Court is not inclined to modify the conditions.
5. Accordingly, this Criminal Miscellaneous Petition is dismissed.
