This Transfer Civil Miscellaneous Petition is filed seeking to withdraw the H.M.O.P.No.17 of 2022 on the file of the Family Court, Pudukkottai and transfer the same to the file of the Family Court, Thiruvallur, to be tried along with H.M.O.P.No.175 of 2021 on the file of
2. The Transfer is sought for by the petitioner/wife on the ground that she is residing in Thiruvallur along with her minor son. It is her grievance that she finds it very difficult to travel alone from Thiruvallur to Pudukkottai. Further, the petitioner/wife is working in Chennai Metro Water Board. She is completely dependent only her mother for survival. Further she has filed petition for restitution of conjugal rights before the Family Court, Thiruvallur, which is pending in H.M.O.P.No.175 of 2021. She has to travel for two hours to reach Chennai and to travel 8 hours to reach to Pudukkottai from Thiruvallur for each appearance and it will result in great hardship. https://hcservices.ecourts.gov.in/hcservices/
3. Heard the learned counsel for the petitioner and perused the materials available on record. The respondent, though served, has not entered appearance.
4. Considering the reasons given and the fact that the petitioner/wife is residing within the Jurisdiction of the Family Court, Thiruvallur, and also she is working in Chennai, this Court is of the considered view that the request for transfer should be allowed.
5.Accordingly, the transfer Civil Miscellaneous Petition is allowed and the Divorce Petition in H.M.O.P.No.17 of 2022 pending on the file of the Family Court, Pudukkottai is withdrawn and transferred to the file of the Family Court, Thiruvallur to be tried along with H.M.O.P.No.175 of 2021.
