The petitioner, who was arrested and remanded to judicial custody on 02.02.2023 for the offences punishable under Sections 294(b), 394, 395, 120B and 506(ii) of IPC in Crime No.421 of 2022, on the file of the respondent police, seeks bail. 2.The case of the prosecution as per the defacto complainant who is working as a Manager in the Spa, is that the petitioner along with other accused trespassed into the said spa and robbed an amount of Rs.8,000/-, 2 1⁄2 sovereigns of gold chain, 25 gram of silver, 8 mobile phones from the working women at knife point. Hence the complaint. 3.Learned counsel for the petitioner submitted that the petitioner is an innocent person and he has nothing to do with the alleged offence. He further submitted that the property has been recovered, but only for the statistical purpose and on suspicion, the petitioner has been
falsely implicated in this case. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court and he is in judicial custody from 02.02.2023 and hence, he prayed to grant bail to the petitioner.
4.Learned Government Advocate (Crl.Side) for the respondent submitted that the petitioner along with other accused trespassed into the spa of the defacto complainant and robbed an amount of Rs.8,000/-, 2 1⁄2 sovereigns of gold chain, 25 gram of silver, 8 mobile phones from the working women at knife point. He further submitted that there are three previous cases pending against the petitioner and the investigation is not yet completed. Hence, he vehemently opposed to grant bail to the petitioner.
5.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) for the respondent and perused the materials available on record.
6.Considering the facts and circumstances of the case and the submissions made by both counsel and the previous bad antecedents of the petitioner and the investigation is not yet completed, this Court is not inclined to grant bail to the petitioner.
7.Accordingly, this Criminal Original Petition is dismissed. 01.03.2023 vkr
