These Civil Miscellaneous Petitions have been filed to recall its common order dated 05.12.2023 passed by this court in C.R.P.No.4312 of 2023 and to hear the arguments on the side of respondents.
2. Today, when the matter taken up for hearing, Mr.N.Manoharan, learned counsel for petitioners would submit that on 05.12.2023, the above Civil Revision Petitions were listed before this court under the caption for admission, but unfortunately, the order has been passed without issuing notice to them. He would submit that even on merits, the petitioners are having valid defence to prove their case, but the common order was passed on merit on that day and disposed of the case. Therefore, he filed these petitions to recall the order passed by this court. He would submit that unless these petitions are ordered, the petitioners would be put into much hardship and no prejudice would be caused to the respondent. 1\3
3. Considering the facts and circumstances and also considering the submissions of Petitioners seems to be justifiable one, this Court is inclined to allow these petitions. Accordingly, in order to give one more opportunity to the petitioners, the order passed by this court dated 05.12.2023 is recalled.
