PRAYER : Criminal Original Petition filed under Section 482 of Criminal Procedure Code, to direct the learned Judicial Magistrate II, Chengalpet, Kancheepuram District to expedite the proceedings in Crl.MP.No.1028 of 2017 in Crime No.41 of 2013 on the file of the learned Judicial Magistrate II, Chengalpet within a stipulated period.

ORDER

This criminal original petition has been filed to direct the learned Judicial Magistrate II, Chengalpet, Kancheepuram District to expedite the 1/4

proceedings in Crl.MP.No.1028 of 2017 in Crime No.41 of 2013 on the file of the learned Judicial Magistrate II, Chengalpet within a stipulated period. 2.Pursuant to the order passed on 29.02.2024, the report has been received from the learned Judicial Magistrate-II, Chengalpattu dated 20.03.2024. On going through the report, it is seen that, there has been absolutely no improvement in the case and in fact, only after the intimation was sent by this Court, the learned Judicial Magistrate became aware of the order passed by this Court and the directions issued by the Apex Court. The report does not give any indication as to what steps are going to be taken to expedite the case and the time frame within which the case is going to be completed. 3.

Taking into consideration the facts and circumstances of the case and the order passed by this Court in Crl.O.P.Nos.24018, 24019, 24990 and 24991 of 2017, dated 21.01.2022 and the directions issued by the Apex Court by order dated 06.05.2022, there shall be a direction to the learned Judicial Magistrate-II, Chengalpattu to pass final orders in Crl.MP.No.1028 of 2017, within a period of four weeks from the date of receipt of copy of this order. Depending upon the order passed in the protest petition, the further proceedings can go on in accordance with law.
