O R D E R

The petitioner has filed the above Writ Petition to issue a Writ of Mandamus directing the 1st respondent to consider the appeal filed by the petitioner on 31.07.2012 and dispose of the same to cancel the patta issued in favour of one Venkatesh S/o Pothalappa in respect of the property in Survey No.353/3 with an extent of 9.41 acres of Unchetty Village, Denkanikottai Taluk, Krishnagiri District.

2.The learned counsel appearing for the petitioner submitted that though the petitioner has filed the appeal as early as on 31.07.2012, the 1st respondent has not disposed of the same yet.

3.Ms.A.Madhumathi, learned Additional Government Pleader appearing for the respondents 1 and 2 submitted that the 1st respondent may be directed to dispose of the appeal on merits and in accordance with law within a period of three months time.

4.Having regard to the submissions made by the learned counsel on either side, taking into consideration the limited prayer sought for by the learned counsel for the petitioner, without expressing any opinion with regard to the merits of the case, I direct the 1st respondent to dispose of the appeal dated 31.07.2012 filed by the petitioner, on merits and in accordance with law, within a period of three months from the date of receipt of a copy of this order.

5.With these observations, the Writ Petition is disposed of. No costs.
