The present Application has been filed to direct the respondent/debtor to pay a sum of Rs.1,94,300/- along with interest as determined by this Court from 18.10.2016, the date of wining up till the date of remittance of principal amount.

2. This Court, by order dated 02.03.2023, ordered notice to the respondent. Hence, the learned Official Liquidator sent a notice to the respondent and the same has been returned with a postal endorsement "deceased".

3. However, it is brought to the knowledge of this Court by the son-in-law of the deceased that his father-in-law died in the year 2000 and thereafter only, the present application came to be filed.

4. Therefore, this Court is of the considered view that the present application has been filed against the dead person by the Official Liquidator. Hence, this Court is inclined to dismiss this application and accordingly, this Company Application is dismissed as abated. There shall be no order as to costs.
