Senammal v. Station House Officer,
IN THE HIGH COURT OF JUDICATURE AT MADRAS
DATED : 29.10.2020
CORAM
THE HONOURABLE MR.JUSTICE T.RAVINDRAN CRL OP.NO.17070 OF 2020 Senammal W/o.Parasuraman
...Petitioner
Vs.
1. Station House Officer Thirupalapandal Police Station Villupuram District
2. Gnanavel S/o.Ganapathi Nainar
...Respondents
Prayer:
Criminal Original Petition filed under Section 482 of Cr.PC praying to issue necessary direction to the respondent police to give police protection for the person and property of the petitioner and her family, by considering the representation dated 07.12.2019, and pass such further or other orders as this Hon'ble Court may deem fit and proper under the circumstances of the case.
For Petitioner : Mr.K.Shakespeare For Respondents For R1 : Ms.M.Prabhavathi Additional Public Prosecutor
ORDER
It appears that the petitioner has obtained an order of Interim Injunction against the counter petitioner in OS No.217 of 2016. However, without enforcing that order against the counter petitioner, the petitioner has now come forward with this Criminal Original Petition seeking for police protection.
2. Admittedly, a civil suit is pending between the parties regarding the property in issue and in such view of the matter, at this stage, I am not inclined to exercise the jurisdiction under Section 482 Cr.PC for granting police protection. As https://hcservices.ecourts.gov.in/hcservices/
already pointed out, the petitioner is directed to enforce the order of injunction in the manner known to law. Resultantly, the Criminal Original Petition is dismissed.
