PRAKASH GOKLANEY Advocate For Respondent : MR.S.SANTHOSH, Govt. Advocate (Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 120(b), 406, 409 and 109 IPC, 13(2) r/w. 13(1)(c)(d) and 13(2) r/w 13(1)(a) and 12 of Prevention of Corruption Act, in Crime No.4 of 2022, on the file of the respondent police, seeks anticipatory bail.

2. This petition has been filed by the 3rd accused, who is the former Block Development Officer and bill signing authority. The First Information Report indicates that more than a crore rupee has been misappropriated in the Dharmapuri District Rural Development and Panchayat Raj Department.

3. The learned Government Advocate (Crl.side) states that the investigation is under progress, the residence of this petitioner was searched and 25 documents were seized. He further states that as of now the petitioner is required for interrogation and he has to appear before the Investigating Officer on receipt of summons. https://hcservices.ecourts.gov.in/hcservices/

4. In the light of the fact that though the petitioner is named as accused in the FIR, the respondent police has not arrested and therefore, apprehension of arrest is not found. The petitioner is supposed to cooperate with the interrogation as and when required on receipt of summons.

5. In view of the same, the Criminal Original Petition is disposed of with a direction to the petitioner that he shall cooperate with the interrogation without any deviation and on such cooperation, the petitioner shall not be arrested unless, until there is a material for the Investigating Officer to proceed in accordance with the provisions of Prevention of Corruption Act to arrest the petitioner to take custodial interrogation.
