PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, or any other Writ, order or direction, directing the 2nd respondent to reconsider the proceedings having ref no. 6840/E2/S2/2022 dated 10.08.2023 and award additional 3 marks to the petitioner for the M.E degree secured by the petitioner in Solar Energy under faculty of Mechanical Engineering in Anna University College of Engineering taking the total marks secured by the petitioner as 146.5 out of 200 in the selection process conducted by the 2nd respondent under notification no. 14/2019 dated 27.11.2019 for the post of Lecturer in Mechanical Engineering and select the petitioner for the post of Lecturer in Mechanical Engineering in any one of the Government Polytechnic colleges based on G.O Ms No. 74 Higher Education (K1) Department dated 15.03.2024 and consequently direct the 3rd respondent to issue appointment order to the petitioner as lecturer in Mechanical Engineering in any one of the Government Polytechnic colleges. ORDER

This Writ Petition has been filed in the nature of a mandamus seeking a direction against the second respondent to reconsider the proceedings dated 10.08.2023 and award additional three marks to the petitioner for M.E. degree secured by him in Solar Energy under Mechanical Engineering in Anna University College of Engineering. The petitioner claims that he must be declared as selected for the post of lecturer in Mechanical Engineering and placed in any Government Polytechnic College.

It is not required to examine the averments made in the affidavit filed in support of this Writ Petition in detail except to state that on 14.09.2022 the petitioner had applied for direct recruitment to the post of lecturer in the Government Polytechnic Colleges and Special Institutions consequent to the notification issued by the Teachers Recruitment Board on 23.11.2019. The petitioner had come within the zone of selection. Though in the Writ Petition the petitioner sought that three marks must be given to him for securing M.E. degree secured in Solar Energy, the said marks had been given and it is now stated on behalf of the respondents that the petitioner is now eligible for being

considered for appointment. This particular issue had been forwarded by the second respondent to the third respondent and now by the third respondent to the first respondent. The first respondent has now received a communication from the third respondent in letter No.28278/B2/2022, on 14.02.2025. Necessary orders of appointment will have to be issued by the first respondent.

3. A direction is issued to the first respondent to issue appropriate orders depending on all the other surrounding factors within a period of three weeks from the date of receipt of a copy of this order, appointing the petitioner as a lecturer in any one of the Government Polytechnic Colleges.
