O R D E R

This petition has been filed to quash the impugned FIR in Crime No.40 of 2024 dated 26.11.2024 on the file of the first respondent Police.

2. On the complaint lodged by the second respondent, the first respondent registered the First Information Report for the offences under Sections 376, 420, 238, 296(b), 351(2) and 118(1) of BNS and Section 4 of the Tamil Nadu Prohibition of Harassment of Women Act, 2002 alleging that on the pretext of marriage, first petitioner compelled the second respondent to have sexual intercourse and thereafter, administered medicine to abort the pregnancy. When the second respondent registered for marriage, she came to understand that the first petitioner already married with the second petitioner.

3. Thereafter, both three had come to her house and attacked her with Beer bottle. Therefore, she sustained grievous injuries. Therefore, the petitioners had committed very serious offence and grave offence and it 2/5

cannot be quashed on the ground of compromise. That apart, now the first respondent completed investigation and filed a final report and the same has been pending for taking cognizance on the file of the Additional Mahila Court, Egmore, Chennai.

4. In view of the above, this Court is not inclined to quash the First Information Report in Crime No. 40 of 2024. Accordingly, this Criminal Original Petition is dismissed. However, the Additional Mahila Court, Egmore, Chennai is directed to take cognizance on the final report filed by the first respondent in Crime No. 40 of 2024, within a period of four weeks from the date of receipt of a copy of this order. 20.02.2025 Index:Yes/No kv 3/5
