The learned counsel appearing for the applicant submits that due to the pre occupancy with other matters of the counsel on record, the petition could not be filed within three months and in view of the said reason now it has become just and necessary to filed a petition to set aside the Additional Award and there arose a delay of 28 days in filing the petition.

3. The learned counsel appearing for the respondents though made a formal objections, he has submitted that the Court may pass an appropriate order.
