ORDER

The petitioner seeks a direction to the 2nd respondent to consider the petitioner's application dated 12.04.2024.

2.It is the case of the petitioner that he is having 10 years experience in CGVFX Computer Graphics field and he wants to set up his own business and therefore, he applied for a loan under Annal Ambedkar Champion Scheme with the 2nd respondent for the project value of Rs.10,36,36,528/- and a subsidy of Rs.1.5 Crores was sanctioned by the Government of Tamil Nadu. However, the 2nd respondent is demanding margin money and collateral security for the said loan, which, according to the petitioner, was not insisted under the Scheme. Therefore, the petitioner seeks for a direction to the 2nd respondent Bank for approval of his loan by considering his application dated 12.04.2024. 3.Heard the learned counsel for the petitioner. Considering the nature of the order to be passed in this writ petition, notice to the respondents is dispensed with.

4.The petitioner has enclosed in the typed set of papers, the letter of the Government of Tamil Nadu, Department of Industries and Commerce, sent to the 2nd respondent Bank, in AABCS No.1403/A3/2024, dated 10.07.2024, requesting the Bank to consider the proposal of the petitioner as per the Bank's Institutional norms and to decide over assisting the project. Therefore, when the Government themselves have clearly indicated that the 2nd respondent Bank can consider the proposal as per their Institutional norms, as a matter of right, the

petitioner cannot seek a direction to the Bank to consider his loan application by dispensing with collateral security as required by the Bank. In such view of the matter, there cannot be any such blanket direction to the Bank. It is for the petitioner to satisfy the norms of the Bank to avail any loan. If the petitioner satisfies the Bank's norms, the 2nd respondent Bank may consider the loan application of the petitioner, as per law.
