O R D E R
The petitioner, who was arrested and remanded to judicial custody on 10.09.2024 for the offences punishable under Sections 8(c), 22(C) of NDPS Act, 1985 in Crime No. 870 of 2024 on the file of the respondent Police, seeks bail.

The allegation against the petitioner is that on 10.09.2024, the petitioner along with other accused were found in possession of 70 grams of Methamphetamine at Karanodai Manthoppu near Sholavaram, illegally. Based on the secret information, the respondent police went to the place of occurrence and intercepted the accused and seized the Methamphetamine. Hence, the respondent police registered a case, and arrested & remanded to judicial custody on 10.09.2024.

Earlier this Court dismissed the bail petition in Crl.O.P.No.23712 of 2025 by order dated 11.09.2025 on the following grounds:- "On seeing the facts, in the scene of occurrence, the respondent police found the petitioner in possession of 70 grams of Methamphetamine illegally without any valid license and the same was recovered, thereby, the petitioner has actively participated in the offence. Considering the facts and circumstances of the case and the submissions made by both counsel, considering the gravity of offence committed by the petitioner by transporting ganja, also the fact that investigation is still pending and there are 22 previous cases pending against him and he is an history sheeter and at this stage if he is released on bail, there is possibility of tampering the witnesses and hampering the investigation, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed".

4.Today, when the matter came up for hearing, Mr.D.Sugumar, learned Counsel for the petitioner submitted that in this case some witnesses were examined and more particularly, PW1 and PW2 have also cross- examined and they have made certain statements in favour of the petitioner and further there is a clear submission of 15 witnesses in this case and hence he prayed to bail.
5.I have gone through the FIR and other connected materials. It seems that there are certain statements which were recorded in his favour. However, whether the said statements are separate grounds for granting bail to the petitioner or not are to be considered only by interpreting such evidence. If such interpretation is made, it would cause prejudice to the interests of both sides and hence, this Court is of the view that the petitioner has moved before the Trial Court for seeking bail in this regard. At the same time, it is also reported by the learned Government Advocate that the case was posted for examination of remaining witnesses and there is likely to be a conclusion of the trial. It is also found that the petitioner has crossexamined the witnesses for nearly 1 1⁄2 years and also considering the stage of the trial, this Court is of the view that the Trial Court is directed to complete the trial as expeditiously as possible from the date of receipt of a 3/4
copy of this order.
6.Accordingly, this Criminal Original Petition is disposed of. 19.02.2026 MSM To 1.The Inspector of Police E-5, Sholavaram Police Station Chennai Crime No. 870 of 2024
