O R D E R
The petitioner seeks Letters of Administration to the estate of the deceased Ramaiah who died on 17.11.1972.
2.According to the petitioner, the said Ramaiah died issue less and his wife Punniyakoti also predeceased him on 03.06.1967. The petitioner claims that he is the brother's grand son of Ramaiah. In the genealogical tree produced by the petitioner, it is claimed that one Mr.Gangaya had two sons viz., Lakshmiaiah and Ramaiah. While Ramaiah
died issue less, Lakshmiaiah died leaving behind a son Govindasamy. The said Govindasamy died leaving behind the present petitioner. Therefore, the petitioner would claim that he is entitled to the estate of the deceased Ramaiah.
3.The petitioner has also filed his voter I.D. Card and that of his wife Parimala. Ex.P.4 is the Secondary School Leaving Certificate of the petitioner wherein Ramaiah has signed as the guardian. The death certificate of Ramaiah has also been produced as Ex.P.1. From the above documents, it is clear that the petitioner is the Class II legal heir of the deceased Ramaiah and he is entitled to Letters of Administration. 4.In view of the above, this application is allowed. The petitioner is entitled to Letters of Administration on executing a security bond for Rs.25,000/- 12.02.2019 ay Speaking order/Non speaking order Internet: Yes/No
