ORDER

This Criminal Original Petition has been filed to direct the learned XI Metropolitan Magistrate, Saidapet, Chennai to discharge the petitioner from the Calender Case in CC No.9193 of 2010.

2. When the matter came up for hearing, learned Additional Public Prosecutor appearing for the respondent submits that the trial of the case in CC.No.9193 of 2010 is almost at fag end, inasmuch as 36 witnesses have been examined and the Investigating Officer has also been examined in Chief. At this stage, the present petition filed by the petitioner to discharge him from the prosecution is not maintainable.

3. In view of the above submission, this Criminal original petition is dismissed.
