he petitioner, who apprehends arrest for the alleged offence punishable under Sections 417 and 376 of IPC in Crime No.2 of 2024, seeks anticipatory bail.

2. The case of the prosecution is that petitioner and the defacto complainant had a love affair and the petitioner promised to marry the victim and induced her to have physical contact and cheated the defacto complainant by not marrying her. Hence, the complaint.

3. The learned counsel appearing for the petitioner submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent submit that petitioner had a love affair with the victim girl aged about 20 years and induced her to have physical contact and cheated the defacto complainant by not marrying her. He further submits that the Statement of the victim girl has also been recorded under Section 164 Cr.P.C. The petitioner had committed sexual assault on the victim girl on false promise of marrying her. Hence, he opposed for grant of anticipatory bail to the petitioner.

Considering the facts and circumstances of the case and also considering the submissions made by the learned counsel on either side, and also considering the allegation level against the petitioner that he had physical contact with the victim girl and thereafter refused to marry her, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. 12.04.2024 nr
