On 21.11.2024, when the matter was taken up for hearing, it was submitted by the petitioner's counsel that the petitioner had taken the bundle long back and to that effect, he will file a memo. However, no such memo is filed.

Be that as it may, today learned Government Advocate appearing for the respondents submitted that the petitioner had only challenged the punishment imposed against him in G.O.(D) No.859 Health & Family Welfare (D1) Department dated 16.08.2013 whereby the punishment of stoppage of increment for the period of six months without cumulative effect was imposed.

3. The petitioner had died on 26.10.2020 and the benefits have also been settled to the legal heirs of the petitioner. In view of the same, nothing survives for further adjudication in this writ petition.

4. Recording the submissions made by learned Government 2/4

Advocate, this writ petition is dismissed. It is made clear that if the benefits are not paid to the legal heirs of the petitioner, it is open to the respondents to settle the benefits after ascertaining the details of the legal heirs of the petitioner. No costs. Consequently, connected miscellaneous petition is closed.
