O R D E R

This petition has been filed to direct the respondent to complete the investigation in Crime No.736 of 2002 and file the charge sheet before the learned District Munsif-cum-Judicial Magistrate, Palladam.

2. Heard the learned counsel for the petitioner; learned Additional Government Pleader appearing for the respondent and perused the materials placed on record.

3. Pursuant to the order dated 12.08.2016 passed by this Court, today, Mr.K.Krishnamoorthy, Deputy Superintendent of Police, Karumathampatty, Coimbatore District has produced Mr.Shanmugam, Inspector of Police, Sulur Police Station, https://hcservices.ecourts.gov.in/hcservices/

Coimbatore District before this Court. The warrant stands recalled.

4. Learned Additional Public Prosecutor on instructions, submitted that on the complaint given by the petitioner, an FIR was registered in Crime No.736 of 2002 and it was closed as mistake of fact as early as in the year 2003. Thereafter, for the same incident, the petitioner has filed a private complaint in C.C.No.399 of 2003 before the learned Judicial Magistrate, Palladam and the said case has been transferred to the file of the learned Judicial Magistrate-VII, Coimbatore and has been renumbered as C.C.No.280 of 2015.

5. In view of the above, this petition is closed with liberty to the petitioner to workout his remedies in the manner known to law.
