This petition has been filed to direct the respondent to complete the investigation in Crime No.761 of 2012 and file the charge sheet before the learned Judicial Magistrate No.VII, Coimbatore.

2. Heard the learned counsel for the petitioner; learned Additional Government Pleader appearing for the respondent and perused the materials placed on record.

3. Today, Mr.K.Krishnamoorthy, Deputy Superintendent of Police, Karumathampatty, Coimbatore District has produced Mr.Shanmugam, Inspector of Police, Sulur Police Station, Coimbatore District before this Court, pursuant to the order dated 12.08.2016 passed by this Court. The warrant stands recalled.

4. Learned Additional Public Prosecutor on instructions, submitted that investigation in Crime No.761 of 2012 was completed and the case was closed as mistake of fact on 09.10.2012. The Police have served RCS No.35 of 2016 on the de facto complainant on 15.08.2016 and has filed the closure report before the learned Judicial Magistrate - VII, Coimbatore on 26.08.2016.
