This Writ Petition has been filed seeking for issuance of a Writ of Mandamus to direct the respondent 1 and 2 to issue the Patta bearing Survey No.5/1 and 5/3 to an extent of 7.48 acres
situated at Poovalai Village, Gummidipoondi Taluk, Thiruvallur District considering the representation dt.29.01.2022.
2. The learned Government Advocate appearing for respondents take notice for the official respondents. In view of the limited relief sought for in this petition and on the consent of the learned counsel appearing on either side, this petition is taken up for final disposal.
3. The case of the petitioner is that the petitioner's property was classified as anandhinam property, however the said property was not acquired by the 1st respondent. Hence, the petitioner made representation to the 2nd respondent on 29.01.2022 for issuance of Patta. However, till date no orders have been passed. Hence, this writ petition is filed with the above said prayer.
4. The learned counsel for the petitioner fairly submitted that the disputed land was classified as anandhinam land a long back and hence, he submitted that, liberty may be granted to the petitioner to work out the remedy in the manner known to law.
5. Though very many grounds raised by the learned counsel for the petitioner, Considering his fair submissions, as the land was classified as anandhinam land, which belongs to the Government, the same cannot be registered in favour of any third party. However, liberty is granted to the petitioner to work out his remedy in the manner known to law.
6. With the aforesaid observation, this writ petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
