This criminal original petition has been filed seeking a direction to the respondent to file a final report in FIR No.349 of 2021 within a time frame fixed by this Court and proceed with the same as per law. 1/4

2. Heard learned counsel for petitioner and learned Additional Public Prosecutor appearing for respondent.

3. Learned Additional Public Prosecutor appearing for respondent submitted that investigation in the case was conducted and closed as 'mistake of fact'.

4. In view of the aforesaid submission, the respondent is directed to serve RCS notice on the de facto complainant and if the de facto complainant is aggrieved, it is left open to him to file a protest petition before the concerned Court.

This Criminal Original Petition is disposed of with the above direction.
