The petitioner challenges the impugned order of dismissal dated 13.02.2024 passed by the first respondent.
2. The facts of the case are that the petitioner who was working as Driver in the respondents Corporation, was involved in the death of conductor and one passenger. After trial, he was found guilty and was sentenced to undergo one year rigorous imprisonment. Though the petitioner preferred criminal appeal, the same was dismissed. Pursuant to the same, the petitioner was surrendered to undergo the sentence. Following his release, the petitioner even rejoined and he was issued with a charge memo dated 09.02.2023 and the second show cause notice dated 27.01.2024 was issued. The charge against him was that he was absent from duty without any information. The petitioner sought time to give reply to the second show cause notice. However, the dismissal order was passed by the first
respondent on 13.02.2024. Challenging the same, the present writ petition has been filed.
3. The learned counsel appearing for the petitioner submits that the approval petition filed under Section 33(2)(b) of the Industrial Disputes Act by the respondents Corporation was dismissed, against which, the respondents have filed a writ petition before this Court, in which, the petitioner is one of the parties.
4. Heard the learned counsel appearing for the petitioner and the learned Standing Counsel appearing for the respondents.
5. In view of the fact that the writ petition filed by the respondents Corporation is pending before this Court, no further adjudication is required in this writ petition.
6. Accordingly, this Writ Petition is closed. There shall be no order as to costs.
